NSL clubs want FKF bodies allowed to resume their mandate

Seven National Super League (NSL) clubs and one Division One club have moved to court seeking intervention to have the Football Kenya Federation Transition Committee (FKFTC) allow Football Kenya Federation Standing Committees to carry out their independent mandates as prescribed by the FKF Constitution.Migori Youth, Dandora Love, Gusii FC, Zoo FC, Kisumu All Stars, Mwatate United, and Coastal Heroes in the NSL and Kamungei United in the FKF Division One League, alongside sports journalist Francis Ngira Okello moved to the Sports Dispute Tribunal (SDT) shortly after the appointment of the FKFTC.In light of the same, the petitioners also want the Transition Committee barred from continuing with the two leagues, the NSL and the Divison One League until the Rtd Justice Aaron Ringera-led committee allows the standing committees to resume their mandate.

The petitioners point out that the FKFTC and their predecessor the Football Kenya Federation Caretaker Committee (FKFCC) have been running leagues without functional FKF Bodies contrary to the FKF constitution and thus should allow those recognized by the FKF constitution to take charge.”The Respondent is without any or any functional Leagues and Competitions, Referees’, Medical, Player Status, Arbitration, Legal, Disciplinary, Ethics and Appeals Committees (hereinafter jointly referred to as the “FKF bodies”) contrary to the FKF Constitution,The said FKF Bodies are tasked with day-to-day league management, appointing match officials and settling match day disputes in the NSL and DOL and their absence will eventually burden this Tribunal with pettier and flimsier disputes hence clogging the wheels of justice,” an excerpt from the petition reads.The return of GMT Ottieno pic.twitter.com/JrrDQ40dfx— Meshack Kisenge (@kisengemeshack1) May 20, 2022 Three days after the petition was presented to the SDT, the FKF Transition Committee moved to appoint in place an Independent Disciplinary Standing Committee effective May 19, 2022, whose mandate is to adjudicate disciplinary matters that are currently pending from the tenure of the FKF Caretaker Committee across all the nationwide leagues, and those that may arise going forward within the Committee’s tenure.Further, the petitioners indicate that the Head of the FKFTC Secretariat Linda Oguttu acted beyond her powers on May 13 when she ordered the continuation of matches across the two leagues, which contravened with the FKF Constitution that they should be following rather and also did what the FKF bodies should do.All matches to go on as planned – Transition Committee insistThey have also pointed out that there is a chance the 2021/2022 season may be annulled to the blatant contravention of the FKF constitution by the FKF Transition Committee and their predecessor unless the Tribunal intervenes.The matter is set for mention on Tuesday 24th May at 2:30 PM EAT.Game of musical chairs as FKF branches and Transition Committee convene separate meetings
