The Sports Disputes Tribunal (SDT) has ruled that the participation of Zoo FC in the 2021-22 National Super League season was illegal. It has further reinstated the FKF Transition Committee decision that handed Shabana FC the abandoned match against Fortune Sacco FC.The two decisions mean that the petitioner (Muhoroni Youth FC) finished third in the season’s NSL table standings and should play the Kenyan Premier League relegation/promotion playoffs against Wazito FC.”The decision of the FKF Independent Disciplinary and Appeals Committee of 19th July 2022 is set aside and the decision by the Transition Committee of 1st July 2022 is upheld. A declaration is hereby issued that the participation of Zoo FC in the FKF NSL 2021/22 was in contravention of the FIFA decision on 23rd April 2021 thus null and void,” the Judge John Ohaga-led tribunal declared.Murang’a Seal, who finished third had earlier on played against Wazito FC in the playoffs which they lost. The latest development will push Murang’a Seal to second on the log hence securing automatic promotion to the 2022-23 KPL with Muhoroni Youth FC in third place playing the playoffs.##NAJAVA_MECA_6742258##The Transition Committee, whose mandate ended over the weekend, ruled that Shabana FC be handed the game against Fortune Sacco that failed to take off due to Madaraka Day Celebrations. However, upon appeal at the Disciplinary Committee, the ruling was reversed in favour of Fortune Sacco. The Tribunal found Fortune Sacco at fault in the abandonment of the game.”Having knowledge that the kick-off time was likely to be delayed due to the said celebrations, it had the obligation to change the kick-off time by giving a written notice to the FKF Leagues and Competitions Committee within 7 days. It is not sufficient that they had a pre-match meeting to change the date in lieu of the Madaraka Day celebrations, the changes can only be made by the Leagues and Competitions Committee. Unfortunately, there is no proof that such communication was made to the Committee and the Committee approved the change of kick off time. In light of the above, Fortune SACCO FC was already in default of the Rules and Regulations from the onset. Sort yourselves! Outgoing Sports CS Amina Mohammed parting shot to clubs”Accordingly, the Tribunal agrees with the decision of the Transition Committee of 1st July 2022 which found that Fortune SACCO forfeits the match in favour of Shabana FC pursuant to Rule 3.3.2 of the FKF Rules & Regulations Governing Kenyan Rules thus awarding Shabana FC three points and two goals.” The Tribunal further ruled that the FKF Independent Disciplinary and Appeals Committee was illegally instituted.
